Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Anureka Inc., a Delaware corporation operating Visacub at visacub.com ("Visacub," "we," "our," or "us"). By accessing or using Visacub (the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Visacub is a self-help software platform that helps you prepare and organize your own U.S. Citizenship and Immigration Services (USCIS) petition. The Service includes a free eligibility self-assessment, AI-assisted draft generation (e.g., I-130 cover letters), guided questionnaires, an evidence organizer, USCIS form generation, and case tracking. The Service does not file petitions with USCIS on your behalf — you review, approve, and file every petition yourself.

3. Not a Law Firm; No Legal Advice; No Attorney–Client Relationship

Visacub is a software product. Anureka Inc. is not a law firm, does not employ attorneys to represent you, and does not provide legal advice or legal services. Communications with Visacub, including with our customer support team, are not protected by attorney–client privilege or the attorney work- product doctrine. Using the Service does not create an attorney–client relationship.

AI-generated drafts, eligibility scores, evidence flags, suggested edits, sample language, and other Service outputs are informational only. They are based on the information you supply and on general public sources (such as USCIS form instructions and the USCIS Policy Manual); they are not tailored legal advice about your specific situation. You are solely responsible for reviewing every output, deciding whether it is accurate and appropriate for your case, and for any decision to file. For advice about your specific situation, consult a licensed U.S. immigration attorney.

Visacub does not provide, bundle, refer, or share fees with attorneys, accredited representatives, or other immigration providers.

4. Eligibility

You must be at least 18 years old, have the legal capacity to enter into a binding contract in your jurisdiction, and not be barred from receiving the Service under applicable U.S. law (including U.S. sanctions and export-control laws — see Section 19). One person or legal entity may maintain no more than one account, except as otherwise expressly agreed by Visacub in writing.

5. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You are responsible for all activities that occur under your account.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Submit information that is false, fraudulent, or knowingly misrepresented to USCIS or any other government agency.
  • Upload malicious code, viruses, or harmful content.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service to store or transmit content that infringes on third-party rights.
  • Share your account credentials with unauthorized third parties.
  • Use the Service to provide legal advice or paid immigration services to third parties unless you are an attorney or accredited representative independently authorized to do so.

7. Your Content and License to Visacub

You retain all ownership rights in the information, documents, and materials you upload to the Service ("Your Content"). You grant Visacub a worldwide, non-exclusive, royalty-free license to process, host, store, transmit, and display Your Content solely for the purpose of operating, maintaining, and improving the Service for you. We do not use Your Content to train any general-purpose AI model. We do not sell Your Content.

8. Confidentiality

We treat the information you upload as confidential and protect it with industry-standard encryption and access controls. Visacub is not a law firm, so confidentiality protections are contractual under these Terms — not the attorney–client privilege or attorney work-product doctrine (see Section 3).

9. Service Availability

We strive to maintain high availability for the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, modify features, or suspend the Service in whole or in part with or without notice.

10. Fees, Payment, and Refunds

  • The Self-File Kit is a one-time fee charged per petition (currently $99 for the Family Self-File Kit; pricing for additional tiers is published on visacub.com). Visacub does not bill subscription or recurring fees for the Self-File Kit unless expressly disclosed at checkout.
  • USCIS filing fees, biometric fees, premium-processing fees, and any other government fees are paid by you directly to USCIS or the relevant agency. They are not included in the Visacub fee and are not refundable by Visacub.
  • Pre-filing satisfaction guarantee. If you are not satisfied with the Service, you may request a full refund of the Visacub platform fee at any time before you submit the petition you prepared with the Service to USCIS, within 30 days of purchase. To request a refund, contact us through our contact form. This guarantee is a customer-satisfaction policy. It is not a representation or warranty about USCIS outcomes, and Visacub does not assess the legal merits of, or take responsibility for, USCIS denials, RFEs, NOIDs, or any other agency decisions.
  • Other fees are non-refundable except where refunds are required by law.
  • We may change pricing prospectively with 30 days' notice on this page or by email.
  • Failure to pay may result in suspension or termination of your account and access to documents prepared through the Service.

11. Intellectual Property

The Service — including its original content, features, functionality, software, templates, AI models, and design — is owned by Anureka Inc. or its licensors and is protected by intellectual property laws. Our trademarks, trade names, and logos may not be used without our prior written consent. Nothing in these Terms transfers any of our intellectual property to you, other than the limited right to use the Service in accordance with these Terms.

12. DISCLAIMER OF WARRANTIES

THE SERVICE AND ALL CONTENT, OUTPUTS, AI-GENERATED DRAFTS, ELIGIBILITY SCORES, EVIDENCE FLAGS, FORMS, AND OTHER MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VISACUB AND ANUREKA INC. DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

VISACUB MAKES NO REPRESENTATION OR WARRANTY THAT ANY PETITION PREPARED WITH THE SERVICE WILL BE APPROVED BY USCIS OR ANY OTHER AGENCY, OR THAT USCIS WILL NOT ISSUE A REQUEST FOR EVIDENCE, NOTICE OF INTENT TO DENY, OR DENIAL. USCIS ADJUDICATIONS DEPEND ON CASE MERITS, EVIDENCE, ADJUDICATOR DISCRETION, AND APPLICABLE LAW AND POLICY, ALL OF WHICH ARE BEYOND VISACUB'S CONTROL.

13. Limitation of Liability

To the maximum extent permitted by law, Visacub and Anureka Inc., and our officers, directors, employees, agents, and affiliates, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunities, immigration benefits, goodwill, or substitute services, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages. Our total cumulative liability for all claims arising out of or related to the Service or these Terms shall not exceed the greater of (a) the amount you actually paid to Visacub in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted.

14. Indemnification

You agree to defend, indemnify, and hold harmless Visacub, Anureka Inc., and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) any information you submit to USCIS or any other agency, or (d) your violation of these Terms or any applicable law.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms or for suspected fraud, abuse, or misuse. You may close your account at any time through the dashboard or by contacting us. After termination you may request export of Your Content for 30 days. After that 30-day window we may delete Your Content in accordance with our retention practices described in the Privacy Policy.

16. Copyright / DMCA Notices

Visacub respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content available through the Service infringes your copyright, send a written notice to our designated DMCA agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that use of the material is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

17. Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. You and Visacub agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (a "Dispute") shall be resolved exclusively by final and binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, rather than in court, except that (i) either party may bring an individual action in small-claims court for disputes within that court's jurisdiction, and (ii) either party may seek equitable relief in court to protect intellectual property rights. The arbitration will be conducted in English, in New York County, New York, or by telephone or video at the arbitrator's discretion. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

Class Action Waiver.YOU AND VISACUB AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

30-Day Opt-Out. You may opt out of this arbitration and class- action-waiver section by emailing legal@visacub.com within 30 days of first accepting these Terms, stating your name, account email, and that you opt out of the arbitration provision.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Subject to the arbitration agreement in Section 17, the exclusive venue for any permitted court action shall be the state or federal courts located in New York County, New York, and both parties consent to the personal jurisdiction of those courts.

19. Export Control and Sanctions

You represent and warrant that (a) you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive U.S. economic sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); (b) you are not listed on the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) Specially Designated Nationals list, the U.S. Department of Commerce's Denied Persons list or Entity List, or any other U.S. government denied-party list; and (c) you will not use the Service in violation of any U.S. export-control or sanctions law.

20. State-Specific Notices

California residents. Visacub is software, not a law firm and not a legal document assistant (LDA). Visacub is not registered as an LDA under California Business and Professions Code §§ 6400–6415, does not provide legal services, and does not offer the services of a registered LDA. The Service is self-help software you use to prepare your own petition. If you have questions about your specific case, consult a California-licensed attorney.

Per California Civil Code § 1789.3. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

New York residents. Visacub is not authorized to practice law in New York. Under New York Judiciary Law § 478, only a licensed attorney may give legal advice or represent you in legal matters. Visacub does neither.

21. Force Majeure

Visacub will not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, public-health emergencies, labor disputes, internet or telecommunications failures, or third-party service outages (including cloud-infrastructure or AI-provider outages).

22. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

23. Entire Agreement; Assignment; No Waiver; Survival

These Terms, together with the Privacy Policy and any order forms or addenda we sign with you, constitute the entire agreement between you and Visacub regarding the Service and supersede any prior or contemporaneous agreements. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. Failure to enforce any provision is not a waiver of our right to enforce it later. Sections that by their nature should survive termination (including Sections 3, 7, 11–14, 16–18, and 20–23) survive termination of these Terms.

24. Electronic Communications and Signatures

By using the Service, you consent to receive communications from Visacub electronically (by email or by posting in the dashboard) and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. You agree that your electronic acceptance of these Terms (for example, by clicking "I agree" or by using the Service) has the same legal effect as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA).

25. Changes to These Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Material changes will be highlighted or sent to you by email. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the modified Terms.
